I'm a bit surprised by this ruling, but not in a negative sense.

I was wondering which states.

It's an outcome that affects more than just one town. Since the 10th Circuit encompasses six states — Utah, Colorado, Wyoming, New Mexico, Kansas and Oklahoma — the decision means it is now illegal for any town in those states to create a law forbidding public toplessness.

I wonder if they'll try to appeal it to the Supreme Court.

The court's ruling determined the law was based on "negative stereotypes depicting women's breasts, but not men's breasts, as sex objects."

I agree with the court's ruling, although I'm not sure what they mean by "negative stereotypes" for women's breasts vs. men's breasts. Men's breasts (especially if they're larger) often get joked about and scorned, while most people have far more positive attitudes towards women's breasts.

Maybe they should let women go topless and require men to wear shirts.

Should have never been anyway... If it's hot enough for a man to rip off his clothes it's certainly hot enough for a woman to do the same. If the human body is shameful to you, you're a nut case... :D

It's not about the attractiveness of the human body either -- women like looking at men's chests just as much as men do the same, respectively.

Although clothing has practical use.....warmth, protection from the sun, etc., it has largely become a vanity thing. If everyone is covered, they escape actual or perceived judgement about their body. Breasts are always "perky" because they are held up by a bra. Penises are hidden from judgement as well.
If breasts were bared most of the time, after a while, the sexual innuendo would die down and the would receive no more attention than someone's nose. Same for penises and butts. There was a time when it was scandalous for a woman to show her bare ankles.......

They say they've had enough and won't be pursuing the issue.

The green colored states are those where top freedom is in effect.
The orange colored ones have ambiguous state laws on the matter.
The red colored ones are the ones where the mere showing of the female breast in public is illegal according to state law.

In the USA, though the majority of states are top-free, some cities in those states have passed (unconstitutional) ordinances that annul the state's top free statute.

In Canada, the law on public decency is found in Sections 173 and 174 of the Criminal Code. However, what constitutes an indecent act is not defined, and is open to interpretation by the courts. Topfreedom is allowed in Ontario, Sasketchawen and British Columbia following specific court cases on the matter but the case for topless equality has not been heard by the Canadian Supreme Court yet.

The following cities are officially topless "tested":

  • Austin, TX,
  • Boulder, CO
  • Columbus, OH
  • Eugene, OR
  • Honolulu, HI
  • Keene, NH
  • Key West, FL at Fantasy Fest
  • Madison, WI,
  • New Orleans, LA, at Mardi Gras
  • New York City
  • Portland, Or,
  • Santa Fe, NM
  • South Miami Beach, FL (on the beach)
  • Washington, DC
It is also legal to be topless in public in the following countries:
  • Canada

I don't see any need for laws against any form of public nudity.
Wear, or not wear, what you want unless it's dangerous to other people.

Her own kids, in her own home.
Me and my wife often walk around our house naked, my kid has seen us naked many times. Not an issue.

There's also that guy in the UK who spent something like 9 years in solitary confinement because he was a nudist and walked everywhere naked.
I find that also despicable.

If a human wants to be naked then that shouldn't be a criminal offence - it's crazy.

Yep, poor old naked rambler (not that old), even when nudity is not illegal in the UK - unless someone apparently is offended by such. :rolleyes:

"Nudity" is simply not the same as "sex", but all too many can't seemingly differentiate between the two. And partially covering body parts up tends to make a game, thus more likely obsessions.

Studies have shown that the average person is more aroused with our peekaboo approach than with in-your-face nudity-- especially if they see a 74 year old body like mine.

NYC been that way for years but yet you only see women topless when making a statement for the news.
Yea. Why even bother with all this if women are not going to hardly use it.

We desperately need more boobies out there and yes us guys will definitely support the whole movement.
