That's the point, murder without premeditation is considered less serious, it can be arguably part mistake, passion- mitigating circumstances
Without premeditation, it's not even murder.

But what I'm saying is, premeditation alone is not what makes murder "murder".

While forethought, planning, conspiracy to commit the act- these all aggravate the crime right?,
Nope. Planning, just another way of saying premeditation, is an element of the crime. And as I pointed out, not the only one. Aggravating factors are different from one state to another, but include things like there being more than one victim, the victim being a child, the victim being a police officer, the murder being committed during the commission of another felony, etc.

There's a rather thoughtful clich'e about this, and it goes "Why do we kill people who kill people to show that killing people is wrong?".

IMO, as long as there's jails and prisons to help protect society, there simply is no reason to have capital punishment if we truly believe human life is sacred.
