The Jan. 2, 2021, recording, provided to The Washington Post by Grossberg’s attorney, features Cruz debriefing Grossberg and Fox Business host Maria Bartiromo on the creation of an electoral commission that would result from the denial of the certification of Joe Biden’s victory on Jan. 6, 2021...​

In the plan Cruz laid out to the Fox News host and her producer, if a majority of the House and Senate objected to electoral certification on Jan. 6, 2021, then an electoral commission would be stood up immediately, commencing a 10-day review period to be completed before the inauguration.​

​

If the commission found “credible evidence of fraud that undermines confidence in the electoral results in any given state,” then the state would then call a special session and recertify results, according to Cruz.​

​

“Is there any chance you can overturn this?” Bartiromo asked Cruz.​

​

“I hope so,” he responded.​

I think Cruz is safe legally because he is not coordinating with other republicans to overturn the election results. He is playing a role that many republicans surely discussed "hypthetically" before Jan 6. The republicans could have sabotaged the results if had been a conspiracy among the many actors who tried to sabotage the process. Getting pence on board would have helped a lot. Guiliani had alternative electors set in five states, with two more unsure about commiting. This is subject to criminal investigation. All that was needed was for there to be enough members objecting to the election results.

Cruz comes off as being loyal to the USA and citing an effort to follow the constitution, but the bottom line is he and all other republicans knew this effort was treason. They just tried to hide under the "uncertainty" of voting machines and vote counts, which wasn't a thing at all. Corruption and treason. Had these guys been able to pull this off competently there wouldn't have been any way to stop them. Cruz is an idiot like many other republicans in congress.
