Judge orders 'don't ask, don't tell' injunction

(CNN) -- A federal judge on Tuesday ordered the U.S. military to stop enforcing the "don't ask, don't tell" policy, effectively ending the ban on openly gay troops.

U.S. District Judge Virginia Phillips' permanent worldwide injunction -- praised by gay rights organizations -- orders the military "immediately to suspend and discontinue any investigation, or discharge, separation, or other proceeding, that may have been commenced" under the "don't ask, don't tell" policy.

The judge, a Clinton appointee based in the Central District of California, previously ruled that the policy regarding gays serving in the military violated service members' Fifth Amendment rights to due process and freedom of speech, but had delayed issuing the injunction.

No, but that hasn't stopped him so far.
But he has also said that only Congress has the power to repeal the law and, until it does, he is bound to defend it in court. Justice Department lawyers defended "don't ask don't tell" before Judge Phillips when the case went to trial in July, but they appeared merely to go through the motions, calling no witnesses or offering up other evidence for its defense and arguing only that Congress should decide on policy rather than a court.

thats the 1st step in the army going to hell in a handbasket. i want no part of it.

Gays were always part of the military. They're just allowed to be out of the closet now. How does that negatively affect the army? What, you think just because gay people don't have to hide themselves that means that every gay person will be somehow inclined to sexually harass and assault their fellows? If it hasn't happened before, then why would it happen now?

But frankly, I'm glad you want no part of it. The fewer bigots we have in the government line of work, the better. Don't let the door hit you on the way out.

Maybe now they'll get rid of the camoflauge and have some more colorful outfits. Heck the way people are so "afraid" of homosexuals, the enemy will retreat without a shot being fired. Couldn't think of a better way to resolve a dispute more peacefully than that.:D
