Sue away climate change? 
I am not sure the EU has a good idea. Seems like legislation by court. This is the court challenging the authority of the voting body which is, in the court's opinion, not doing its job so we'll do it for you.
European Court of Human Rights (ECHR) has ruled that weak government climate policies violate fundamental human rights. The ECHR found that Switzerland had violated the rights of a group of older Swiss women to family life due to its failure to adequately address climate change. Now every citizen in Europe can plead for relief from the courts.
