My question is who exactly is the person or person's that decides what is misinformation, and what is not misinformation?

Send them an email and ask.
Twitter is a private company, they can do whatever they want.

Publicly traded =/= social service covered under government 1a requirements for social services.

Microsoft, Tesla and Amazon are also publicly traded. They can still set policy including content regulation.
