At this point it is probably possible to sue for the government to restrain itself from such future interactions. We have the benefit of hind-sight and can ask the courts to review the decisions made, whether they were legal or illegal.

Trump used the below which has never been challenged in court. If it were that would mean Bush and Obama would be guilty on a far large scale.

No as it would throw Obama under the bus and undermine the US' war on terror.

I don't know, but it might help to restrain future administrations from getting us involved without more congressional approval. There could be other avenues for similar legal actions, too.
The court to try war criminals is in The Hague, Netherlands. But the US never ratified the Rome Statute.

As per the US 11A the US can decline the case anyways. Given that the US is the major backer of the ICC and UN attacking the hand that feeds has consequences.
