"Two lawsuits filed in Massachusetts and Germany claim the Pfizer-BioNTech Covid-19 vaccine violated Moderna’s mRNA patents.

The vaccine manufacturer Moderna sued Pfizer and BioNTech on Friday, claiming that its rivals’ Covid-19 shot copied groundbreaking technology that Moderna had developed years before the pandemic.

The allegation of patent infringement sets up what could become a protracted and expensive legal battle between the companies behind coronavirus vaccines that have saved millions of lives worldwide and raised hopes for future medical products using similar messenger RNA, or mRNA, technology.

Experts said Moderna’s litigation, regardless of its outcome, was unlikely to impede access to Covid vaccines or chill the development of mRNA products. But the outcome could dictate whether Pfizer or Moderna controls and profits more from a powerful and lucrative medical technology.

“The battle really is who is going to be, in the future, the go-to source that other companies may have to license from,” said Ameet Sarpatwari, an expert on pharmaceutical policy and law at Harvard Medical School. For Moderna, he said, “establishing their ownership and their dominance in this space is going to set the stage for future royalties that they’re going to get.”

In two lawsuits on Friday, Moderna claimed that Pfizer and its development partner, BioNTech, had infringed on three patents that Moderna filed between 2011 and 2016 related to its mRNA technology. One lawsuit was filed in U.S. District Court in Massachusetts, where Moderna is based, and the other in Germany, home to BioNTech."

Disgraceful!
No doubt there are similar instances of companies copying groundbreaking medical intervention from others in some capacity.
Though lawsuits may be less likely to occur in counties outside the US

After all, we are speaking of a country where healthcare is considered a profitable business, through insurance companies whose aim is the profit maximization and they are never satisfied.
As a consequence the big pharma will deal with medicinal products as a means to create billions of dollars out of nowhere.

I agree. I'm sure seat belts must be an infringement of some aspect of the American constitution. Can anyone still doubt that cars are simply vehicles for socialism? (Clue: what colour was the flag?)

Ok, I hear what NYT is saying, but in Moderna's defense I feel like they are way better at making vaccines. I don't know if they got lucky, but their vaccine was better. My dad got the Pfizer and was not as lucky as me. I got theirs, and it was effective for me. I have benefited personally, and I am in favor of Moderna winning these suits. I want their next vaccine, too.

I am biased for irrational reasons, but really if Moderna has a patent then let them go for their money.

By the way, the next round of vaccines won't all target the same variants of covid. It will matter which company you go with. I will be tempted to go with several companies instead of one.

Sorry for your dad's bad experience. He may have had a bad experience with any of them.

They need to be worried about saving lives like the seatbelt, not how much they can profit. That's my opinion
