The Indian Supreme Court has expanded the right to abortion for unmarried women to 24 weeks in view of the socio economic vulnerability such women may face.

Indian SC members (as well as all lower courts) are not picked by the political parties, but by peers among the judges themselves usually in order of seniority or experience, though the govt. has to give approvals.

Sorry, I am not wholly in favor of this. DIY. Masturbation is a better way for men as well as women, if they cannot do without it - seriously. No after-effects.
Then, it is still not the law. Supreme Court cannot make a law. Making a law is the province of the Parliament and not of Supreme Court.
Technical point, to which even the Supreme Court will agree. Supreme Court also has to go by law.

Parliament has already made the law that abortion is legal and unrestricted up to 24 weeks (Medical Termination of Pregnancy Act Amendment Bill 2020, already passed).

The SC is only stating that it applies to unmarried women as well.

So it is the law.

  1. survivors of sexual assault or rape or incest
  2. minors
  3. change of marital status during the pregnancy (widowhood and divorce)
  4. women with physical disabilities
  5. mentally ill women
  6. the foetal anomalies that have substantial risk of being incompatible with life or if the child is born it may suffer from such physical or mental abnormalities to be seriously handicapped
  7. women with pregnancy in humanitarian settings or disaster or emergency

Read the bill. Failure of contraceptives to work is considered a valid reason for termination.

  • Termination due to failure of contraceptive method or device: Under the Act a pregnancy may be terminated up to 20 weeks by a married woman in the case of failure of contraceptive method or device. The Bill allows unmarried women to also terminate a pregnancy for this reason.
