It is not that. The Indian government is seriously thinking of changing the antiquated British law of 1862. The law was drafted by the infamous Lord Macauley. Section 377A was incorporated in 1938. India criminalized homosexuality until June 2, 2009, when the High Court of Delhi declared section 377 of the Indian Penal Code invalid. India has reinstated its ban on homosexuality on December 11, 2013, making it a criminal offense punishable by imprisonment up to a life time. It had to do this because the courts do not have the jurisdiction to invalidate laws. It is the function of the Parliament. The police overlook such cases. However, changing the law is difficult because it would not be liked by any of the three major religions (Hinduism, Islam and Christianity). It also depends of the numbers of the ruling party in the Parliament and in the Upper House (where the current government does not have majority). So, no immediate action is possible. In a democracy like ours, one cannot ride rough-shod over people's desires.

HAF is amazing. I feel proud to have an American Hindu group behind me who is a strong open minded group who stands up for dharma no matter what.
It takes guts to do this and criticize India's stance.

“The impunity that the cops have increasingly exhibited certainly come from the fact that now the Supreme Court is openly saying that we [LGBTs] are illegal/criminals. This is a direct outcome of the wide debate and news that followed the Supreme Court judgement. Certainly we are already seeing an increase in violence, both by the police as well as by private lumpens.”
