Terrorists are not protected by the Geneva Convention.
As I've pointed out, many countries have found ways around such things. They would be protected, but they aren't legally considered enemy combatants due to the lack of a formal declaration of war.

Only protected if the nation in question has laws about it.

Terrorist are not soldiers so no declaration of war changes them into legal combatants, ever.
