If you had read it the Espionage Act does not refer to just spying. It also refers to people that merely took highly classified documents. They need not have sold them.

And we already know that Trump broke this law:

18 U.S. Code § 1924 - Unauthorized removal and retention of classified documents or material

He voluntarily turned over some documents, I think it was about 17 boxes of them, earlier this year. Why didn't he return all of the documents? They went easy on him the first time since that alone could have secured a conviction if they wanted to play hard ball.

He is British but i do not think that he favors Trump. It would fall under self deprecating humor. What does Godwin's Law say about that?

EDiT: It appears that Godwin himself would disagree with you:

The DoJ and FBI won't want to move until they are sure of their ground, presumably.

Well, if it's classified nuclear documents, that doesn't sound like something they want to play around with or take any chances on.

Well, they knew he had documents. The National Archives made statements to that effect pretty much from the outset. I don't recall that it was treated as a particularly huge story, or at least, it seemed to be more of a back burner item compared to everything else that was going on.

Maybe they didn't know there were any classified nuclear documents among them, but who can say?
