It doesn't. HE BROKE THE LAW after being warned.
I don't know what you have studied, but I have a law degree. This is a clear case of " transgressing the principle of proportionality of the penalty".
That is, you can disobey the judge's orders with the culpa (negligence) and not the dolus (intention), but a proportional penalty can be a high mulct, or fine.
Nine months detention is absolutely not compatible with this case.
Italian newspapers before writing that article consult jurists who agree on that.
