A protected class ? I think not. How can a member of an alleged protected class then be convicted of a hate crime for spray painting racist slurs on the walls of a white Christian church ? It has happened.

As in the case of all crimes, the people are the victims.

If my neighbor burns a cross in his front yard, is that a hate crime ?
Because religion is a protected class. Even a "white" Christian Church. (and talk about tipping your hand). Being a member of a protected class doesn't make you immune to being charged with a hate crime.

So, now that I've answered your deflection, perhaps you'd like to answer my actual question?

and if you can show that the crime was motivated by hate against 'the people', and 'the people' qualify as a protected class, I guess you'd have a hate crime. Do you have evidence of such a motive?

If it's his front yard, I wouldn't have thought so. I don't think you understand what hate crimes are.

Ever notice the people most upset about concepts like "hate crimes" are the people who can't actually explain what a "hate crime" is?

We are talking about the narrative of false accusations and Trump's base overemphasizing punishment such as calling Smollett to be charged with a hate crime. Smollett's case does not fit the legal definition of a hate crime. sure, it fits the definition of filing a false report, but it surely does not fit the role of slander/defamation (assuming the two white men conjured in his story do not exist). So my point in the OP is if we as observers are going to say those who make false accusations ought to serve the same amount of time those who are accused and convicted, then are we are we going to say that we will have the same mindset of those misusing law enforcement resources to falsely accuse someone?



My initial reaction to the first Smollet thread was based on Smolett's version of the event, the second was an evolution based on the evidence and his credibility.

I never imparted my personal opinion in the first thread, only in the second (it helps if you actually read the paraphrase in the first thread). As far as deflection, if you cared to read the initial post, I was referencing the Facebook comments by Trump supporters calling for Smollett to be charged with a hate crime. I don't know why you're flattering yourself.

It does not take much to figure out your MO. Also you are ignoring the back and forth between you and Kangaroo complaining about how many feel vindicated from the lefts boogieman caricature

This is the really awful thing about the Smollett debacle, ie, that even though
it's widely recognized as a fraud...to falsely demonize Trump, supporters, voters
& white folk....it's still being used to demonize Trump, voters & supporters.
This can only encourage more such frauds because true or not the effect
is nearly the same, ie, justifying their feelings of opposition & hatred.

Moreover, there shouldn't even be an issue about some false accusations
being acceptable, while others aren't....all based upon race & politics of
the parties involved. Let it be known: It's always wrong. Prosecute'm.

Oh, I clearly understand what they are, and they have nothing to do with alleged protected classes. Further, intent is not necessarily an element of the crime.

A hate crime exists when acts of animus against another appear to be the result of the hatred of another because of race, sex, religion, sexual orientation, handicap, etc.

A white straight male beaten up by a group of homosexuals for being straight, and if that element can be shown, he is a victim of a hate crime.

I never said Smollet committed a hate crime.

I was exploring why people might consider it so.

Toss in how easily the media failed to be journalists, again, magnified the coverage willingly as it fit the agenda of various political hacks pretending to be journalists.

Such as Obama is not legally qualified to be President? Or that Obama ordered the FBI to wiretap his campaign headquarters?
