    I believe that death penalty does not have an Islamic basis, too. I even believe that the punishment of 100 lashes for gays is not correct. Indeed, the punishment of being gay (physical practice) is Ta'zir, and not Had. Ta'zir is always less than Had. The punishment of adultary is Had.
