MyPillow files $1.6 billion suit to counter Dominion defamation case (cnbc.com)

  • Dominion is suing MyPillow and Lindell, a loyal supporter of Donald Trump, in a $1.3 billion defamation lawsuit.
  • Dominion accuses Lindell of harming the company’s reputation by spreading the false claim that it rigged the 2020 election for President Joe Biden.

MyPillow, the bedding company led by the pro-Trump CEO Mike Lindell, on Monday filed a $1.6 billion lawsuit against Dominion Voting Systems, which is currently suing Lindell and his business for defamation.

“This is a free-speech case. This is a First Amendment case,” Lindell said on a livestreamed broadcast announcing the lawsuit.

The election-technology firm Dominion sued MyPillow and Lindell in February, accusing them of spreading the false claim that the company rigged the 2020 election for President Joe Biden by manipulating votes. Former President Donald Trump’s campaign and his allies lost dozens of lawsuits in their sweeping effort to overturn key states’ election results and flip the outcome of the race.

Dominion is seeking more than $1.3 billion in punitive and compensatory damages, saying the “viral disinformation campaign” spread by Lindell and others has “irreparably damaged” the company’s reputation. Dominion has filed similar lawsuits against Trump’s lawyer Rudy Giuliani, attorney Sidney Powell and Fox News.

The suit makes a distinction between MyPillow and Lindell, claiming that Lindell was speaking only for himself, not for MyPillow. The lawyer for Dominion called the suit "meritless."

The new complaint from MyPillow, filed in Minnesota federal court, accuses Dominion of waging an “illegal campaign to punish and silence their critics.”

MyPillow’s lawsuit also makes a distinction between Lindell and his company, arguing, “MyPillow has not engaged in discussion about the 2020 election.”

“In making these statements, Lindell spoke for himself, not MyPillow,” the lawsuit says.

Andrew Parker, a lawyer for MyPillow, denied that MyPillow’s court action constituted a countersuit against Dominion.

But the lawsuit itself says it is being brought “to remedy the grave harm that has been suffered by MyPillow as a result of Dominion’s suppression of speech and attacks on the Company.”

This is a meritless retaliatory lawsuit, filed by MyPillow to try to distract from the harm it caused to Dominion,” said Stephen Shackelford, legal counsel for Dominion, in a statement to CNBC.

He would be smart to separate himself from his company because it is a huge asset that could be lost due to losing the suit against him.

If he is claiming a free speech stand as a counter suit I can't see that working since libel and slander are not protected speech. But it's absurd because Dominion isn't part of any government agency that is violating his rights. If his lawyers are going that route they probably aren't very objective or competent.

I'm expecting that by this time next year, we're going to start seeing ads for Dominion Pillows.

I think if it results in guilty parties paying for their wrongs against legitimate companies by spreading lies about them, then the public wins. We all win, expect for the liars.

The problem is that baseless suits, SLAPP suits, & malicious
suits are costly, & work great injustice against innocent parties.
Anyone who brings suit should be confident of a win. If not,
they should be ready to compensate the defendant for damages
they cause.

Yes, SLAPP suits are an issue. But Mr. Pillow Head getting sued, is not a SLAPP suit. It's a legit libel suit.

It is a suit that has such low merit that it will almost certainly be tossed out of court. And it will likely only hurt him in regards to Dominion's lawsuit against him.

It's not only liberals and lawyers. Companies and rich people also like to end legal disputes by simply outspending the opposing party.

He strikes me as being of the lawyer ilk.
Note how he's attracted to politics, which
is a nest riddled with such predators.

IRL & on RF, the loser pay system is typically
fervently opposed by liberals, who favor the
right to sue anyone for anything without any
responsibility for unjust damage done.
They've said they like the idea that the little
guy can **** up the big guy...no matter the cost.

I was speaking of those who advocate against loser-pay.
Of course, the system is what it is, & everyone is stuck
with dysfunctional rules. So such behavior becomes the
rule for all. A loser-pay system will tend to keep all in line.

Still, the defendant incurs legal costs in addressing
even meritless suits. MyPillow guy should be forced
to hold them harmless (pay their costs).

Considering the vast amounts of money involved in these suits, MyPillow guy is going to have to sell a lot of pillows to be able to cover those costs.

It's why we make money, ie, to do things we want to do.

When I've faced wrongful lawsuits, it's often cheaper
to pay them off than to go to court & win. I never
settle them. I'd rather spend the extra money to win.
Why?
1) It's immoral to incentivize legal extortion.
2) I'm a stubborn *****************.
