Did Biden Step In It?

Drunk driving isn't a felony. Why would someone think it is? Biden said he thinks people who commit felonies should be deported and drunk driving doesn't reach that level.

What am I missing here?

I have heard prior DUI history could lead up to a Felony Charge for a DUI.

It's usually a misdemeanor on the first offense.

A felony on the second offense.

No, it's not a felony on the second offense. Always fact check RW media and stop taking their word that a DUI is a felony. A small % of DUI's are felonies. And if someone's DUI fell into that serious category, it sounds like Biden would have them deported. Due to stating he wants "felons to be deported"

Most legal advice sources I've found seem to suggest that it CAN be a felony in extreme or repeated cases, but is mostly just considered a misdemeanor.

He's tecnically correct, but it seems his position could at least have done with more clarification.

They majority of DUI's are not felonies, by a long shot. We have people here thinking a 2nd DUI is automatically a felony. Even a 3rd DUI isn't a felony.

Seems that Joe doesn't think that drunk driving is a big thing according to an interview with Vice News.
Not sure how you magically leap from "it's not a felony", to it's not a big thing? Did he say it's not a big deal, or do you stuff nonsense words into his mouth? Everyone here is saying it's not a felony too, but no one is saying it's not a big thing. Only you fantasize such an unreality. "Drunk driving is okay with them Dems," or some such insanity.

Yeah, I think based on that the statement "DUIs are not felony offences" is accurate.

Are there any states which consider it a felony on the first offence?
Quick google search
Question
I just got charged with a DUI (driving under the influence of alcohol). If I'm found guilty, will I have a felony conviction on my record? Or is a DUI a misdemeanor?
Answer
Generally, it's possible to be convicted of a DUI as a misdemeanor or a felony. A standard first offense is almost always going to be a misdemeanor. But a DUI offender who kills or seriously injures another person is typically looking at felony charges—even if it's the person's first offense. (Read more about criminal charges for DUI-related killings.)

Having prior DUI convictions can also elevate a DUI to a felony. In some states, first and second DUI offenses are misdemeanors but a third or subsequent conviction is a felony. (Learn about how long a prior DUI conviction stays on your record.)

There are also states that make a DUI a felony if the driver had a particularly high blood alcohol concentration (BAC) or was transporting children while driving under the influence

No, no states have a first offense DUI as a felony. Other countries do though
In Arizona, drunk driving is a class 1 misdemeanor, with a conviction netting a 3-12 month license suspension, an ignition device that won't start the car if the driver blows a .08 or above, and possible probation for up to 3 years.
