Prosecutors counter that nudity is commonly understood to include women’s breasts in American society and that courts have upheld laws based on morality.

“It was in the privacy of my own home,” Buchanan said after a court hearing Tuesday where a judge said she plans to rule in the coming months. “My husband was right next to me in the same exact manner that I was, and he’s not being prosecuted.”

Buchanan, 27, said she and her husband had taken off their shirts to keep their clothes from getting dusty while they hung drywall in their garage in a Salt Lake City suburb in late 2017 or early 2018.

When her husband’s three children, ages 9 through 13, walked in, she “explained she considers herself a feminist and wanted to make a point that everybody should be fine with walking around their house or elsewhere with skin showing,” her lawyers said in court documents.

Buchanan was charged with three counts of misdemeanor lewdness involving a child in February. It came after child welfare officials began an investigation involving the kids that wasn’t related to Buchanan."

How does going topless in front of a child make you a sex offender, whether in or out of your home? Aren't women allowed to breastfeed in that state? are all moms going to be arrested for that as well?
With all the actual crime there is to deal with, why is the police spending resources on tripe like this?

What the article doesn't mention is that the criminal complaint was filed by her husbands ex-wife, the mother of the children. Pretty plainly a case of vindictive, vexatious complaint, and I hope the court treats it as such.

The red colored ones are the ones where the mere showing of the female breast in public is illegal according to state law.


Many municipalities within the states and provinces where such toplessness is legal have ordinances, however, that prevent such a liberal dress code in public places such as parks, beaches, etc. under the guise of “disorderly conduct” or “public lewdness” related to their “nude” display. While most of these ordinances are likely illegal themselves, they continue to be enforced and will continue to be so until they are challenged in a court of law."

Granted that clothes do protect a person to some degree or another when doing most things, but having put up my share of drywall I don't see any overriding need for wearing a top of some kind.

By the word comfort I refer to the common sense of comfortable, safe and secure clothing when working with cutting, drilling and impact tools.

If you want to carry out such work when topless, good luck to you.

All I've ever needed was a pencil, measuring tape, drywall T-square, drill with a phillips head bit, a utility knife, and a step ladder. :shrug:
