Why is India’s justice system “notoriously slow” at convicting an alleged terrorist?

‘A firebrand Hindu nationalist nun facing terrorism charges over the deadly bombing of a mosque has been elected to the Indian parliament, a week after Prime Minister Narendra Modi condemned her for celebrating the assassin of independence hero Mahatma Gandhi.

Sadhvi Pragya Thakur is accused of participating in the 2008 attack that killed six people and injured more than 100 others.

She spent nine years in detention over the charge and is still awaiting a trial for terrorism and criminal conspiracy after being bailed in 2017.’

My question though is why wouldn’t India prioritise cases of terrorism? If the allegations are true it seems unjust to make the victims wait so long for the truth to come out. On the other hand if they are all fake it seems equally unjust for a potentially innocent person to be in detention for 9 years.

The police is under the BJP government in whose party this lady belongs. The police won't do a thing as long as BJP holds power. You can't prosecute a case if the police are interested in burying the evidence under orders of the govt.

The system is slow even in case of even for Muslim/arrested Pakistani terrorists. It is slow for all, civil cases, political cases or criminal. It is an inheritance from the British system. Lawyers, various ways to post-pone hearings, corrupt court staff, corrupt police asking for time for investigations repeatedly, bail/paroles, multiple courts to appeal to (district level, state level, national level, ending with an appeal to the President of India). It is sort of engineered for delay, not just in one particular case.

In the time of native kings and nawabs, a Kotwal or a Kazi would hear the case from both parties and give the decision then and there, no delay. Heavy punishment for the Kotwal or Kazi who errs.
