Judge stops Mojave Cross land swap
ACLU hails decision to get rid of the religious icon

The latest blow to the Mojave Cross could bring an end to the fixture that has graced the top of a rock outcropping in the Mojave National Preserve for years.

A federal judge in Riverside has ruled in favor of the American Civil Liberties Union of Southern California, declaring a land swap designed to preserve the cross unconstitutional. His action will force the National Park Service to stop the land-exchange process and remove the cross.

U.S. District Court Judge Robert J. Timlin concluded in his 11-page decision issued Friday that the land exchange does not end the government's involvement with the cross, which he had previously found to violate the First Amendment because it is on federal land.

Yeah, the ACLU gets a bad rep. It's mission is to defend the constitution and especially the amendments. While many of it's "opponents" decry the ACLU, they often forget that many cases where "percieved opponents" have been defended. The thought is that even as one case of freedom is taken unconstutionally the whole constitution becomes at risk - the "sloppery slope" of constitutional law. When you lose a right, mine are diminshed, as the saying goes.
