The United States District Court for the Middle District of Florida shall have jurisdiction to hear, determine, and render judgment on a suit or claim by or on behalf of Theresa Marie Schiavo for the alleged violation of any right of Theresa Marie Schiavo under the Constitution or laws of the United States relating to the withholding or withdrawal of food, fluids, or medical treatment necessary to sustain her life.

The Congress and the President have stepped out of thier constitutional roles and are playing 'god' with another branch of the Government. They are flaunting the the Constitution and breaking its strict guidelines.

I'm not Pah, but I know the answer... Yes, every year between 5 and 10 laws will be passed that apply to a specific individual. I'm pretty sure that this is the first time that one has been passed to grant rights to an individual, though - other laws that are passed for individuals almost exclusively address punishment - never the granting of special rights.

PS - with the revelation of the law passed while Bush was Governor of Texas, it should be obvious that his claim that he wants to "err on the side of life" as opposed to "I'm sucking up to the religious right for some more votes for my party" holds as much water as the "We're here to remove the threat of WMD's" as opposed to "I'm starting this war to make sure that my cronies in the military/industrial complex make their needed profits" or "It's about what is right, not about oil". The man has no shame when it comes to power or money - none.

Bush pushed for and then signed into law a Texas bill that allowed doctors and hospitals to remove a feeding tube if the patient could not pay (indigent) REGARDLESS of the wishes of the family or the prognosis of the patient.

It's a pity the "liberal" media never calls him on his flip-flopping.

The first federal court has denied re-inserting the tube.
he has upheld the Florida courts decisions.
Next it`s on to the Atlanta appelate.

U.S. District Judge James Whittemore said the 41-year-old woman's parents, Bob and Mary Schindler, had not established a "substantial likelihood of success" at trial on the merits of their arguments.

Whittemore wrote that Schiavo's "life and liberty interests" had been protected by Florida courts. Despite "these difficult and time-strained circumstances," he wrote, "this court is constrained to apply the law to the issues before it."

There are 35,000 persons in a persistent vegetative state at any given time in the US. This type of decision is being made every day -- privately.

There are thousands of hospices across the US caring for the dying during their final weeks. Almost all of these could have their lives (suffering?) extended if they were moved to hospital. Would the Republican right shut down hospice services?

Bush said, in reference to this controversy: "In extroardinary circumstances like this it is wise to err on the side of life." As governor of Texas he presided over many executions. A shocking number of inmates on death row in the US have been found innocent on later investigation. But Bush never commuted the sentence of anyone; never seriously examined a single appeal. Indeed, he was even heard to mock one appellant.

The Republican "Talking Points" paper, which was leaked to the press, makes it clear the Republicans are treating this affair as a campaign appeal to the religious right.
