I wasn't sure if I should have put this here or in the Philosophy section.
Anyway, the reason for making this thread is to explain to everyone why hate crime laws should be abolished. Let's start off with an example. Bob Jones is a white supremicist who hates blacks, Jews, gays, Roman Catholics, etc. He decides he wants to vent his anger by beating a black person. He proceeds to do this. He then is caught by the police and is charged with assault (rightly so). Now, should he also be charged with a hate crime? No, he shouldn't and here's why. Hate crime laws equal thought crime (from 1984). You should be charged for the crime you committed (assault) - you shouldn't be charged for what you were thinking before and during the crime. I think it's scary that the State can serve you criminal charges for what you think on top of whatever crime you committed. Thoughts?

I concur 100%! We already have laws under which to prosecute criminals, so all hate crime laws do is effective provide unequal treatment based on who the victim is.

You can't prosecute people for their emotions, only their actions. Hate, though unseemly, is part of the spectrum like it or not.

My views on hate crime legislation are not strong one way or the other, but I tend to favor hate crime legislation. The reason I tend to favor hate crime legislation is because when someone targets a victim based on what group they belong to (be it based on race, sexual orientation, sex, whatever), that crime isn't commited just to harm that one victim. It is aimed at the group in which the victim belongs as a sort of example. Crimes commited just because the targeted victim is a member of a certain group are not commited just to harm that one person. Such crimes are also aimed at intimidating members of the victim's group. It is committed to instill fear in that group. For example: If a white supremacist intentionally targets a black person as a victim just because of the person is black in a murder or assault, that crime is not just commited to harm that one black person. It is commited to intimidate members of the black community. Also, when a person decides to commit a crime against a person targeted just because they belong to a certain group, that shows that the person who committed the crime has premeditated their actions to some extent. These are some things I considered when I formed my opinion on hate crime legislation. As I said, my opinion isn't set in stone and could be changed, but at the moment, I favor hate crimes legislation.

Sorry! Motive is a valid criteria in establishing a crime and in punishing a crime.
