I don't have a problem punishing the swastika painter more than the smiley face painter as others have mentioned, motive and action are fair game in determining punishment. Where I have a problem with 'hate crime' is disparate treatment for the same crime carried out with the same motivation.
This is slightly different... they should both be punished the same =p

Person A beats a homosexual man to death because he is a homosexual.

Person B beats a man to death because he slept with his wife and killed his brother.

Who should have the harsher punishment and who is more likely to repeat his actions?

Both are guilty of murder. Both should face the same punishment.

I am mixed race, white and Pakistani, but I look more white. At my high school no one ever bothered about my race until the other kids found out I was Pakistani. Then I called all kinds of slurs, assaulted, and had my things stolen and ruined.
If they did not know my race they would have had no motives and would not have bothered me.

The same thing happened when people found out I was gay. There were no taunts, no slurs, no being pinned to the ground as people kicked me in the genitals while calling me "lesbo" when they assumed I was straight.


These hurtful actions and assaults would not have happened had I been a full white and straight girl. I don't buy this "all crimes are a hate crime." Hatred for minourities was common at my high school, crimes that otherwise never occured happened against us.
