The libertarians among you might know who professor Van Dun is. Well, he gives some lectures to the libertarian organization I'm affiliated with these days, and in a previous lecture he discussed the whole "person" issue. I totally support what he said. (Note: he never gave a clear answer on a question I asked him about abortion other than that it's a case to case issue).
Some things are based on contracts. Anyone who can reason, is a person. Now, since it's just us humans who can reason, only humans can be persons. To be able to reason, is to enter a discussion with rational arguments and defend your existence (for example). It is true that unborn babies are not persons that way. But neither are babies that have just been born, or people who sleep. For that, he argued, there exists some implicit contract, which says that we are not supposed to ignore the "rights" (let's leave the discussion about what rights are for another topic) of human beings who are capable of reaching the status of reasoning - or else (which seems utilitarian) we could get killed in our sleep as well. That way, it is never okay to kill a person or a human being. Just my two cents here.
