If a man strikes an obviously pregnant woman in the stomach with a baseball bat and she loses the child, should the man be charged with murder?

Hmmm...not sure. Doesn't it depend on how far along she is (as far as the law is concerned). I know Manson and his cult were charged with murder for Sharon Tate Polanski's unborn child and it had something to do with how far along she was (8 months, I think). I think it should depend on whether the fetus was far enough along to live outside the womb.

Obviously pregnant is not the same thing as the fetus being able to survive outside the womb. People start showing pregnancy sometimes as early as 4 months and sometimes as late as 7.

Well, for me my first answer still stands. And of course he should be charged with assault on the woman.

I think there are enough creeps out there that didn't want a baby who would do this if he was only charged with assault.
