Hmmm...not sure. Doesn't it depend on how far along she is (as far as the law is concerned). I know Manson and his cult were charged with murder for Sharon Tate Polanski's unborn child and it had something to do with how far along she was (8 months, I think). I think it should depend on whether the fetus was far enough along to live outside the womb.
